Exclamation Libra 'arrested & detained' after baby death

KADAMAT: Lakshadweep port authorities on Tuesday 'arrested and detained' cruise liner MV Super Star Libra for an hour in connection with the death of a 14-month-old American citizen of Indian origin, on Nov 21 last year.

The arrest was on the basis of an interim order of the Kerala High Court. This is the first time that a passenger vessel has been ordered by a court in India to be arrested and detained.

The ship was released after the master of the vessel furnished a bank guarantee of Rs 10 lakh, port sources said. The vessel, which arrived here from Mumbai, has already left on its return journey.

The interim order was issued by Justice CN Ramachandran Nair on a petition filed by the baby girl Neuna Shah's parents - Mehul Shah and Natasha Banerji - seeking action against the vessel for the 'negligence' which resulted in their only child's death by drowning.

The court had directed the Lakshadweep Port officer to arrest and detain the vessel, owned by Starcruises, Malaysia, when she arrived in any port under the control of Lakshadweep administration and release it only on furnishing a bank guarantee of Rs 10 lakh towards damages claimed by the petitioners for the death of their child.

Neuna Shah, a passenger of the Mumbai-Lakshadweep liner, had drowned when the small boat in which she along with her parents boarded near Kadmath Island in Lakshadweep, overturned in heavy rains and rough sea.

The excursion entailed the passengers disembarking from the liner into a smaller vessel to get to the island.
